Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website, member area, insurance quote and purchase tools, online store, and membership and insurance services (together, the “Services”) provided by Vagabundos del Mar Boat and Travel Club, Inc. (“Vagabundos,” “we,” “us,” or “our”). Please read these Terms carefully.

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. Insurance products are available only to eligible members and are subject to the eligibility requirements of our insurance partners. By using the Services, you represent that the information you provide is accurate, current, and complete.

2. Membership

Membership in Vagabundos is offered on an annual, per-household basis at the then-current dues rate. Membership benefits, dues, and renewal terms may change from time to time. Dues are generally non-refundable except where required by law. You are responsible for keeping your membership information current and for renewing your membership to maintain access to member benefits, including the ability to purchase or renew insurance.

3. Insurance products — important notices

Vagabundos acts as an authorized insurance agent. We help eligible members obtain Mexican auto, boat, and related insurance that is underwritten and issued by our insurance partners, not by Vagabundos. The following apply to all insurance transactions through the Services:

Quotes are estimates. Premiums, coverage, and eligibility are determined by the underwriting insurer and are subject to change. A quote does not bind coverage and is not a guarantee that a policy will be issued.
The policy controls. Your coverage is governed solely by the terms, conditions, limits, exclusions, and declarations of the policy issued by the insurer. If anything on the Services conflicts with your policy, the policy governs.
Coverage is effective only when issued. Coverage applies only for the dates and terms stated in the issued policy after payment is received and the policy is issued.
No professional advice. Information on the Services is general in nature and is not insurance, legal, tax, or financial advice. You are responsible for selecting coverage that meets your needs. We recommend you review your policy documents and consult the insurer or a qualified professional with questions.
Accuracy of information. Insurance applications rely on the information you provide. Inaccurate or incomplete information may affect coverage, claims, or eligibility, and may result in denial or cancellation by the insurer.
Claims. Claims are handled by the insurer and its adjusters according to the policy. Vagabundos may assist members but does not adjust, approve, or pay claims.

4. Travel information

Our website includes travel information such as border-crossing details, required documents, road reports, mileage guides, customs and safety information, and similar content. This information is provided for general convenience only, may change without notice, and may not be current or accurate. Border requirements, government rules, fees, and conditions are set by third parties and governmental authorities. You are responsible for verifying current requirements before you travel. We make no warranty regarding this information.

5. Accounts and security

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

6. Purchases, payments, and refunds

You can purchase membership, insurance, store products, and certain events and services through the Services. Payments are processed by our third-party payment provider, and you agree to its applicable terms. You represent that you are authorized to use the payment method you provide. All fees are stated at the time of purchase.

Insurance premiums, taxes, and fees are governed by the insurer’s terms and the issued policy; cancellation and refund rights, if any, are determined by the policy and applicable law. Membership dues are generally non-refundable. Store product returns and refunds, if offered, are subject to the terms presented at checkout.

7. Online store

Product descriptions, pricing, and availability are subject to change and may contain errors. We reserve the right to correct errors, limit quantities, and cancel orders. Title and risk of loss for physical products pass to you upon delivery to the carrier unless otherwise stated.

8. Community features and user content

The Services may let you post or submit content, including classifieds, road reports, photos, travel-buddy profiles, event sign-ups, and messages (“User Content”). You are solely responsible for your User Content and represent that you have the rights to share it and that it does not violate any law or third-party right.

By submitting User Content, you grant Vagabundos a non-exclusive, royalty-free, worldwide license to use, host, store, reproduce, display, and distribute it in connection with operating and promoting the Services. You can remove your User Content, but copies may remain in backups or where others have shared it.

9. Acceptable use

You agree not to:

violate any law or the rights of others;
post content that is unlawful, fraudulent, defamatory, harassing, infringing, or harmful;
provide false information or impersonate another person;
interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
use bots, scrapers, or automated means to access or harvest data except as expressly permitted; or
use the Services to send spam or unsolicited communications.

10. Intellectual property

The Services and their content—including text, graphics, logos, the Vagabundos name and marks, and software—are owned by Vagabundos or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Services for their intended personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission, except as allowed by law.

11. Third-party services and links

The Services may link to or integrate third-party websites and tools, including our insurance partners’ and payment providers’ platforms. We do not control and are not responsible for third-party services, and your use of them is subject to their own terms and policies.

12. Disclaimers

Except as expressly stated and to the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that information provided will be accurate or current.

13. Limitation of liability

To the fullest extent permitted by law, Vagabundos and its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the greater of the amount you paid to Vagabundos for the applicable Service in the twelve months before the claim or one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not affect the rights and obligations under any insurance policy, which are governed by the policy itself.

14. Indemnification

You agree to indemnify and hold harmless Vagabundos and its officers, directors, employees, volunteers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the Services, our members, or others. Provisions that by their nature should survive termination will survive.

16. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Solano County, California, and you consent to their jurisdiction, except where applicable law provides otherwise.

17. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above. Your continued use of the Services after an update means you accept the revised Terms.
